Terms of Service

These Terms of Service (the "Terms") govern your use of the Valitux service (the "Service"). By accessing and using Valitux, you agree to be bound by these terms. If you do not accept these conditions, you must not use the Service and must immediately cease any use.

1. Definitions

Valitux :
refers to the company publishing the Service and the marketing data validation platform accessible via the valitux.com website.
Service :
refers to all features, tools and services offered by Valitux for the validation, segmentation and reliability of marketing data.
User :
any individual or legal entity accessing the Service, whether registered on the waiting list, account holder, or simple visitor to the site.
Data :
all information collected, processed, validated or segmented via the Service, including emails, phone numbers, IBAN and IP addresses.
Account :
personal space created by the User to access Service features.
API :
programming interface allowing integration of the Service into the User's computer systems.
Webhooks :
automatic notification mechanism that sends data in real-time to a URL defined by the User when an event occurs on the Service.
CRM integrations :
native connections with customer relationship management software (Salesforce, HubSpot, Pipedrive, Zoho, etc.) enabling automatic synchronization of validated data.
Marketing and e-commerce platforms :
third-party tools and solutions (Mailchimp, SendGrid, Brevo, Shopify, WooCommerce, PrestaShop, Zapier, Make, etc.) with which the Service can integrate to validate data before sending or processing.
CDN :
Content Delivery Network, a content distribution network allowing the Service to be integrated directly into web pages via a script tag for real-time form validation.
SDK :
Software Development Kit, a set of tools and libraries (JavaScript, Python, PHP, Java, C#, etc.) provided by Valitux to facilitate integration of the Service into User applications.

2. Purpose and scope

These Terms define the conditions for accessing and using the Valitux Service, as well as the rights and obligations of the parties. They apply to all Service Users, without exception or reservation.

3. Acceptance of terms

Use of the Service, whether free or paid, implies full and complete acceptance of these Terms. This acceptance is materialized by creating an account, registering on the waiting list, or any other use of the Service. If you do not accept these conditions, you must not use the Service and must immediately cease any use.

4. Service description

Valitux is a real-time marketing data validation platform that improves customer acquisition data quality, optimizes marketing campaigns and protects sender reputation. The Service is hosted by OVH in France and includes in particular:

  • Real-time email address validation (syntax, domain, MX records, SMTP connection, etc.)
  • Phone number validation (format, carrier, line type)
  • IBAN format validation (structure, length, checksum)
  • IP address validation and geolocation
  • Temporary and disposable email detection
  • Bot and fraud detection
  • Lead segmentation to optimize your marketing campaigns
  • Bulk database cleaning
  • Integration via API and webhooks

5. Service access

Access to the Service is conditional upon:

  • Registration on the waiting list for users in the launch phase
  • Creation of a user account with email address validation
  • Acceptance of these Terms
  • Compliance with applicable legislation

Valitux reserves the right to refuse access to the Service to any User who does not comply with these conditions. Valitux may also modify, suspend or interrupt the Service at any time, particularly for maintenance, security or force majeure reasons, without notice or compensation.

6. Service use

The User agrees to use the Service in accordance with its intended purpose and in compliance with applicable laws. The following are strictly prohibited:

  • Any fraudulent, abusive or illegal use of the Service
  • Reproduction, copying or unauthorized commercial exploitation of the Service
  • Any attempt to gain unauthorized access to Valitux systems
  • Use of the Service for spam, harassment or illegal activities
  • Transmission of data containing viruses, malware or any malicious code
  • Any manipulation or alteration of validation results
  • Use of the Service to validate data without the consent of the persons concerned

In case of violation of these rules, Valitux reserves the right to suspend or terminate access to the Service immediately, without notice or refund.

7. Data and privacy

The processing of personal data collected in the context of using the Service is governed by our Privacy Policy, accessible at any time on the site. By using the Service, the User expressly consents to the processing of their personal data in accordance with this policy. Valitux undertakes to:

  • Comply with the General Data Protection Regulation (GDPR) and applicable legislation
  • Collect only data strictly necessary for providing the Service
  • Not sell, rent or share personal data with third parties for commercial purposes
  • Implement appropriate security measures to protect data
  • Retain data only for the period necessary for the purposes for which it was collected

The User has a right of access, rectification, deletion and opposition to their personal data, which they can exercise by contacting Valitux at contact@valitux.com.

8. Intellectual property

All elements of the Service are the exclusive property of Valitux or its partners and are protected by intellectual property laws, including:

  • Texts, articles, documentation and editorial content
  • Images, logos, trademarks and distinctive signs
  • Software, source codes, algorithms and databases
  • The structure, design and ergonomics of the Service
  • APIs, interfaces and communication protocols

Any reproduction, representation, modification, publication or adaptation of all or part of the Service, by any process whatsoever, is prohibited without prior written authorization from Valitux. The User acknowledges that use of the Service does not confer any property rights on the Service elements.

9. Pricing and payment

Access to the Service may be free (launch phase, waiting list) or paid according to the plans offered by Valitux. Prices are indicated in euros including tax and may be modified at any time. For paid services:

  • Payment is made according to the methods indicated at the time of subscription
  • Invoices are issued automatically and sent by email
  • In case of recurring payment, the subscription is automatically renewed unless terminated
  • Any late payment may result in suspension or termination of the Service
  • Refunds are subject to Valitux's general terms of sale

Valitux reserves the right to modify its prices at any time. Price changes apply to subscription renewals following notification of the change.

10. Availability and liability

Valitux strives to ensure the availability and reliability of the Service 24/7, but cannot guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance
  • Technical updates
  • Force majeure
  • Technical failures independent of Valitux's will

Valitux shall not be liable for any direct or indirect damages resulting from the use or inability to use the Service, including: data loss, loss of revenue, loss of customers, loss of reputation, or any other financial loss. Valitux's liability is limited to the amount of sums paid by the User over the last 12 months.

11. User obligations

The User undertakes to:

  • Provide accurate, complete and up-to-date information when creating their account
  • Maintain the confidentiality of their login credentials
  • Immediately notify Valitux in case of unauthorized use of their account
  • Use the Service in accordance with its intended purpose and these Terms
  • Respect the rights of third parties and applicable legislation
  • Not disrupt the operation of the Service or Valitux servers

The User is solely responsible for the use made of their account and the data validated via the Service. They guarantee Valitux against any claim resulting from non-compliant use of the Service.

12. Termination

The User may terminate their account at any time from their personal space or by contacting Valitux. Valitux may terminate or suspend access to the Service in case of:

  • Violation of these Terms
  • Non-payment of amounts due
  • Fraudulent or abusive use of the Service
  • Account inactivity for an extended period
  • Decision to close the Service

In case of termination, access to the Service is immediately suspended. User data may be retained in accordance with the Privacy Policy or deleted at the User's request.

13. Modification of terms

Valitux reserves the right to modify these Terms at any time to adapt to legal, technical or commercial developments. Modifications take effect upon publication on the site. It is advisable to consult this page regularly. Continued use of the Service after publication of modifications constitutes acceptance of the new Terms.

14. Applicable law and jurisdiction

These Terms are governed by French law. In case of dispute relating to their interpretation or execution, and in the absence of an amicable agreement, the parties undertake to seek a solution through mediation before any legal action. In the absence of agreement, any dispute falls under the exclusive jurisdiction of French courts, even in case of multiple defendants or third-party claims.
